Burke County traffic cases are heard at the Burke County Courthouse on South Green Street in Morganton. Our office is about thirty miles east in Hickory — a straight shot down I-40 — and for most traffic matters, you won't need to come with us.

Evan Rowe leads the firm's traffic and criminal defense practice. Before co-founding King & Rowe, he was an Assistant District Attorney — he has seen every kind of traffic case from the prosecution side of the courtroom, and he brings that knowledge to the defense.

Whether you were cited in Morganton, Valdese, Drexel, or Glen Alpine — or you picked up a ticket on I-40 through Burke County — we can review the citation, tell you what you're looking at, and handle court on your behalf.

§ II — What we handle

Traffic tickets in western NC, kept off your record when we can.

Paying a traffic ticket is an admission of guilt — and that admission costs you twice: once in court and again in higher insurance premiums. We fight for reductions, PJCs, and dismissals that keep your record clean.

  1. I.

    Speeding tickets

From 5-over school-zone tickets to 25-over misdemeanors. Most cases resolve with a reduction, a Prayer for Judgment Continued (PJC), or an improper-equipment plea that keeps points off your license — and keeps your insurance level. See why paying the ticket is rarely the cheap option.

  2. II.

    Reckless driving

Reckless driving under N.C.G.S. § 20-140 is a Class 2 misdemeanor — a criminal charge, not a traffic infraction. Conviction adds 4 DMV points and 4 insurance points. We work to reduce or dismiss wherever the facts allow.

  3. III.

    Driving while license revoked

DWLR carries a Class 3 misdemeanor conviction, additional revocation time, and insurance consequences. We evaluate the underlying revocation — many can be reduced to "no operator's license" (N.C.G.S. § 20-7) with the right facts. See our guide on DWLR in NC.

  4. IV.

    CDL traffic violations

CDL holders cannot accept a PJC on a traffic ticket issued in a commercial vehicle — and federal rules mean even a conviction in your personal car can cost you the CDL. We know the rules and the workarounds. See protecting your CDL after a ticket.

  5. V.

Failure to appear / missed court dates

A Failure to Appear triggers a license revocation twenty days after the missed date and an additional $200 fee. We can often strike the FTA, reinstate the case, and prevent further harm — but time matters.

  6. VI.

No insurance, expired tags & moving violations

Driving without insurance is a Class 1 misdemeanor that can carry jail time. Expired tags, improper equipment, and other minor violations often come bundled with more serious charges. We handle the whole stack at once.

“Got a speeding ticket in Burke County and Evan kept my CDL clean. That is my paycheck. Cannot thank him enough.”

§ IV — Frequently asked

Questions about traffic tickets in Morganton, answered.

Should I just pay my ticket?+

Almost never. Paying a North Carolina traffic ticket is a guilty plea — it adds DMV and insurance points, and most insurance companies raise premiums for three years. For most drivers, the lawyer's fee is less than a single year of higher premiums. See the real cost of paying a ticket.

How will a ticket affect my insurance?+

North Carolina uses the Safe Driver Incentive Plan (SDIP) under N.C.G.S. § 58-36-65. Each ticket adds insurance points: 1 point for a minor speeding ticket = roughly 30% premium increase for three years. Reckless driving and DWI carry far more. The goal in almost every case is to avoid the conviction that triggers the point.

What is a PJC (Prayer for Judgment Continued)?+

A PJC lets you admit responsibility without the court entering a judgment of conviction. The result: no DMV points, no insurance points, no premium increase. You get two PJCs in a three-year period for insurance purposes and one every five years for your license under N.C.G.S. § 20-16. CDL holders and some offenses cannot use PJCs.

Can my lawyer go to court without me in Morganton?+

For most traffic infractions, yes. We can file a waiver and appear on your behalf so you don't have to take off work or drive in. Criminal traffic charges (like DWLR or reckless driving) may require your appearance.

What happens if I miss my court date?+

The court enters a Failure to Appear. Twenty days later the NC DMV revokes your license under N.C.G.S. § 20-24.2 and adds a $200 fee. The charge doesn't disappear — it waits. Call us right away if you've missed a court date; we can often strike the FTA before the revocation takes effect.

How long do points stay on my NC driving record?+

DMV points stay on your record for three years from the conviction date; insurance points also use a three-year window. After three years they stop affecting your premium, but the underlying conviction stays on your driving history indefinitely.

Does reckless driving stay on my record forever?+

The conviction stays on your criminal and driving records indefinitely. Expungement may be available for first-time offenders under limited circumstances. The DMV points and insurance points drop off after three years.

Will you handle a CDL ticket for me in Morganton?+

Yes — but it matters more, not less. CDL holders can't accept a PJC on a commercial-vehicle ticket, and federal disqualification rules under N.C.G.S. § 20-17.4 are severe. We have defended CDL drivers across Catawba, Burke, and Caldwell counties and know what is and isn't negotiable.
